DUI Penalties in Mission Viejo: What You’re Up Against

Mission Viejo enforces DUI laws harshly – Orange County is one of the strictest counties when it comes to DUIs in all of California.  You do not want to find yourself facing DUI charges here but if you do, here’s what you are facing in court.

First Time DUI Offense

A first-time DUI in Mission Viejo is typically charged as a misdemeanor. You face up to six months in the Orange County jail and fines that, with added penalties and assessments, can come close to roughly $20,000. Your driver’s license may be suspended for 4 to 12 months (sometimes longer because there are two separate DMV suspensions, one from the DMV and one from court). However, if you didn’t refuse a chemical test, you may qualify for a restricted license by installing an Ignition Interlock Device (IID) for six months (can be as long as nine months), or you can get a restricted license for work-related driving (generally to and from work). You’ll also be required to attend a weekly DUI education program lasting 3, 6, or 9 months. The good news? Our firm has had an extremely high success rate in helping our clients avoid jail altogether. 

Second Time DUI Offense

If you’re arrested for a second DUI, the consequences increase significantly. Any second offense in CA requires a minimum of 96 hours in jail (4 days), up to a maximum of one year in county jail. Fines and penalties can again reach somewhere near $20,000, and your license may be suspended for a year or revoked for two years. In many cases, you can obtain limited driving privileges with an IID installed for 12 months. However, this doesn’t apply if you refused testing or if you were on probation for your first DUI when you received the second DUI. You’ll also be required to enroll in a very long DUI class – minimum of eighteen months, up to thirty months.  The court requires probation, and oftentimes demands AA meetings, MADD, community service or labor, and even an ankle alcohol monitor.

Misdemeanor DUI with Injury (This assumes a very minor injury)

Causing a minor injury while driving under the influence turns a standard DUI into a much more serious charge. If charged as a misdemeanor, a minimum of five days in jail are required, up to one year in jail. Fines again go up to $20,000, and you will be forced to pay restitution payments to the injured party. Your license could be suspended for 1 to 3 years, without the option for a restricted license. A regular misdemeanor DUI with injury carries a one year hard suspension of your license – that means you can’t even drive with a breathalyzer or a restricted license. The court will also require DUI education classes ranging from 3 to 30 months, depending on the circumstances. If the injury is more severe, prosecutors will escalate the case to a felony.

Felony DUI (Fourth Offense in 10 Years)

A fourth DUI within a ten-year span is almost always filed as a felony and comes with life-altering consequences. Depending on the severity of your case, you face prison time up to many years. County jail is required at a minimum in this instance, and the DA often wants a year or more of jail, or several years in state prison. Fines can reach $20,000, and your driver’s license may be suspended or revoked for up to 10 years. You’ll also be ordered to complete an 18- or 30-month DUI education program, among many other harsh conditions like having to check in with a probation officer, request permission to travel, random drug and alcohol testing, etc.
